of Sharkgroup AG in relation to workconnect.ch
The following terms of use of Sharkgroup AG apply to the use of the workconnect.ch online tool by users. A user is any natural or legal person who registers on the workconnect.ch online platform. By registering on workconnect.ch, the user agrees to the terms of use.
workconnect.ch is a free online platform of Sharkgroup AG. It brings together users with excess personnel capacity on the one hand and short-term personnel shortages on the other. workconnect.ch is aimed exclusively at entrepreneurs, professional companies and tradespeople from various sectors.
With workconnect.ch, Sharkgroup AG provides a network for the execution of work between users. Users can offer work services or work opportunities on the platform and respond to corresponding adverts from other users.
The offer of workconnect.ch does not cover any contractual relationship between the users that arises through the use of the platform and is independent of Sharkgroup AG. Users acknowledge that Sharkgroup AG merely provides a platform. The conclusion and content of the contractual relationship arising from the use of the Platform is the sole responsibility of the Users.
The use of workconnect.ch requires the proper registration of the user as well as agreement to the terms of use and the data protection provisions.
It is at the discretion of Sharkgroup AG to activate a user on the platform. Activation may be refused without giving reasons. In particular, Sharkgroup AG reserves the right to allow only business customers to use workconnect.ch and to exclude individual users with immediate effect in the event of a breach of these terms of use. Sharkgoup AG may also block a user from the platform without giving reasons.
The use of workconnect.ch is free of charge. The user may only use workconnect.ch for the purposes listed above. In particular, the user may neither copy data from other users nor use it for other purposes.
The user must provide the data requested during registration completely and truthfully and must update this data immediately in the event of a change in the course of use. In particular, the user may not use workconnect.ch in abuse of rights or for illegal purposes. The user is also prohibited from harassing other users in an unauthorised manner, e.g. through advertising or spam.
It is the responsibility of the user to check whether they have the necessary authorisations to use workconnect.ch and to conclude any contracts based on it, in particular for any staff leasing. The user must then protect their access data from unauthorised use by third parties and not impair or excessively burden the operation of workconnect.ch.
Users accept that their performance can be evaluated by other users on the workconnect.ch platform. Sharkgroup AG does not check these ratings in any way. However, it reserves the right to delete a review upon request.
Sharkgroup AG makes the use of workconnect.ch available to the user, whereby there is no entitlement to uninterrupted accessibility at all times. For technical and other reasons, in particular due to necessary maintenance and repair work, force majeure or a culpable breach of the terms of use by the user, the availability of workconnect.ch may be restricted.
Sharkgroup AG is free to call in a third party to provide workconnect.ch or to leave it entirely to a third party.
The user indemnifies Sharkgroup AG from any liability and from any damages if third parties assert claims against Sharkgroup AG that are attributable to the non-compliant use of workconnect.ch. The indemnification obligation also includes Sharkgroup AG's own expenses incurred in connection with official proceedings or investigations initiated by the user. The User shall support Sharkgroup AG to an appropriate and reasonable extent.
Sharkgroup AG rejects any liability of any kind in connection with the use of workconnect.ch, unless the cause of the damage is based on grossly negligent or intentional behaviour. In particular, Sharkgroup AG cannot be held liable for the following: The accuracy and timeliness of the information on workconnect.ch, the conclusion and content of the contract between the users, compliance with any contractual and/or legal provisions by the users, non-performance or improper performance of a contract concluded between the users, non-contractual liability for damages caused by a user.
Liability for indirect or consequential damages as well as for damages resulting from interruption, faulty operation or malfunction of workconnect.ch, including loss of data, is hereby excluded. Insurance is the sole responsibility of the user.
Should the use of workconnect.ch result in the processing of personal data, Sharkgroup AG complies with the applicable data protection regulations. Information on the handling of personal data can be found in the privacy policy at www.sharkgroup.ch.
The user undertakes to comply with the applicable data protection provisions when using workconnect.ch and hereby confirms the accuracy of the personal data that the user discloses about other persons, as well as the permissibility of the disclosure of the same.
Sharkgroup AG does not exercise any arbitration function in the event of disputes between users.
Changes to these Terms of Use will be communicated to the user in an appropriate manner. If the user's objection is not received by Sharkgroup AG within 30 days of receipt, these amendments shall be deemed to have been accepted.
The exclusive place of jurisdiction for all legal disputes arising from or in connection with the use of workconnect.ch is the registered office of Sharkgroup AG
